TERMS OF TRADE AND CONDITIONS

 

By booking, you are accepting the following terms and agree to be legally bound by it. Any persons found breaking these terms and conditions will be immediately required to leave the property and no refund will be given.

 

To the extent permitted by law:

 

  • Any duty or liability that Blue Mountain Lake Limited and/or Blue Mountain Station Limited has to you that may be excluded is excluded.
  • Blue Mountain Lake Limited and/or Blue Mountain Station Limited are not liable for anything that is beyond our control.
  • Blue Mountain Lake Limited and/or Blue Mountain Station Limited will not be liable to you or anyone else for, and you waive and will indemnify Blue Mountain Lake Limited and/or Blue Mountain Station Limited in relation to, any claims (in contract or tort, including negligence, under statute or otherwise), any physical or mental injury, trauma, creation or worsening of a medical condition or death of you or others, any damage to or loss or theft of property, disruption to travel, or any indirect damage, loss, or costs resulting from your booking with Blue Mountain Lake Limited and/or Blue Mountain Station Limited and any activities you undertake under the booking, whether or not such activities were authorised by Blue Mountain Lake Limited.

 

Blue Mountain Station Ltd or Blue Mountain Lake Ltd cannot be held responsible for any damages of personal property, vehicles, injuries or loss of life that may occur when crossing the Orari River. All persons crossing the Orari River must have extensive river crossing experience before booking. 4x4 vehicles are required to cross the river. Blue Mountain Station Ltd or Blue Mountain Lake Ltd is not required to assist vehicles if they are stuck while crossing the Orari River or anywhere on the station.

 

FARM WARNINGS & GENERAL RULES

 

Blue Mountain Station is a fully operational farm. Sheep, cattle and wild animals are located throughout the entire farm. Animals can be unpredictable and dangerous. Avoid animals at all time. Our shepherds may be shifting large mobs of stock at any time. Please stay well away and allow them to pass.

 

There are many fences, rock slips, creeks, rivers, fences, bluffs, wheel ruts, uneven surfaces, slippery tracks, wildlife, livestock and poisonous plants around the farm. Move with caution.

 

You must not enter any farm buildings. You are only permitted to enter buildings where you have been given our specific authority to do so.

 

Blue Mountain Station Ltd or Blue Mountain Lake Ltd is not required to assist vehicles if they are stuck while crossing the Orari River or anywhere else on the station.

 

No Camping anywhere on the farm.

 

Please securely lock every gate that you go through with the latch or chain. Please do not hook gate latches to the fence wires.

 

All accommodation MUST be left clean and tidy as it was found. Including but not limited to; dishes, towels put in allocated basket, clean floors, bin bags tied and all rubbish inside ready for dumping etc. Anything not left as it was found will incur a cleaning fee.

 

All fires must be contained to the inside wood fire or outdoor fire pit. No other fires are permitted at any time. If there is a Fire Ban in the area, the outdoor fire must not be lit. 

 

NO alcohol is to be consumed on the farm outside of allocated areas or while driving on the farm. Guests caught driving while under the influence will be charged for the entire trip duration and be asked to leave the premises.

 

Only REEF SAFE sunscreen is permitted at Blue Mountain Lake.

 

STRICTLY NO OFF-FARM DOGS PERMITTED ANYWHERE ON THE PROPERTY.

 

SELF CONTAINED VEHICLES

 

Your vehicle MUST be fully self contained - with your own water, power and ablution facilities. There are water points right next to the Wool Shed.

 

HUNTING & FISHING

 

There is a zero tolerance policy for hunting on Blue Mountain Station private property without permission.

 

All guns and hunting equipment must be stored safety.

 

Fishing along the Orari River is very welcome. Fishing in the Blue Mountain Lake is strictly forbidden. Absolutely NO fishing or hunting equipment is to enter the Blue Mountain Lake boundary. Strictly NO fishing is allowed at Blue Mountain Lake at any time. 

 

Any purchaser or guests that are found poaching will be asked to leave immediately. No refunds will be given, and trophy fees will be applied for all poached animals. Blue Mountain Station Ltd or Blue Mountain Lake Ltd will prosecute any guests caught poaching.

 

PURCHASER AND GUESTS

 

All purchasers and guests of our accommodation facilities shall be over 18 years of age. Any person under 18 will not be allowed access to the Property without the approval of Blue Mountain Lake Limited. All persons under the age of 18 must be supervised at all times by a legal guardian.

 

All purchasers and guests must remain within the boundaries of their booked  accommodation or marked trails unless accompanied by a Blue Mountain Lake Ltd guide or Real Kiwi Hunting Guide. Access to the farm land, private buildings, farm buildings or unmarked tracks is strictly forbidden. Anyone found to be outside of the boundaries of Blue Mountain Lake will be prosecuted for trespassing.

 

All purchasers and guests shall be held fully accountable & liable for their behaviour and damages caused. Any damages beyond normal wear and tear to property of Blue Mountain Station Ltd or Blue Mountain Lake Ltd, will be charged to the purchaser. This includes loss of animals or any livestock. Blue Mountain Station Ltd and/or Blue Mountain Lake Ltd reserves the right to remove any persons, any vehicles or animals at any time.

 

PAYMENTS, CANCELLATION AND REFUNDS

 

A 50% deposit is required at booking via bank transfer, debit card or Credit Card via our online booking service. Full payment is required by the end of the trip. Debit cards, credit card and cash are accepted on site. Deposit is refundable up to 30 days before booking. Full refunds, when eligible, will be allocated to purchaser up until 30 days prior to start date of booking.

 

Cancellation

 

Cancellation by us:

 

Typically, we would only ever cancel a booking because of extreme weather events such as heavy snow or floods.

 

We reserve the right to cancel any bookings at any time without warning. Full refunds will be allocated to purchaser if Blue Mountain Station Ltd or Blue Mountain Lake Ltd cancels your booking before the date of arrival. Blue Mountain Station Ltd or Blue Mountain Lake Ltd reserves the right to end any booking at any time for any reason within the duration of the booking.

Blue Mountain Station Ltd or Blue Mountain Lake Ltd are not responsible for the weather conditions. All alternate accommodation, rebooking or refunds are at the discretion of Blue Mountain Lake Ltd and Blue Mountain Station Ltd.

 

Cancellation by Purchaser:

 

Full refunds, when eligible, will be allocated to purchaser up until 30 days prior to start date of booking. Within 30 days of booking refunds will not be given in the event of sickness or death of purchaser, the death of a family member, riots, wars, acts of God, flight cancellations and so forth. Purchasers are advised to procure travel insurance to recover expenses that may be incurred if you are unable to carry out your booking.

 

REFUNDS

 

Full refunds, when eligible, will be allocated to purchaser up until 30 days prior to start date of booking.

 

TRANSFERS


All bookings, except those within 7 days of arrival date, may be transferred to another date so long as that date is within 12 months of initial booking. In case of a booking transfer there is an amendment fee. Deposits cannot be transferred to book alternate accommodation, activities or packages options  at Blue Mountain Station.  If a booking is not re-booked within 12 months of the original booking, the full fee will be charged to the purchaser.


  • Transfer within 7 - 10 days of arrival date: NZD 100 per group amendment fee.
    • Transfer within 29 days of arrival date: NZD 50 per group amendment fee.
    • Transfer within 60 days of arrival date: NZD 50 per group amendment fee.

 

INSURANCE

 

Blue Mountain Station Ltd and Blue Mountain Lake Ltd highly recommends purchasing comprehensive travel insurance. Including but not limited to; trip cancellation and interruption, accidental death, emergency evacuation and repatriation, medical and hospital expenses, baggage protection and emergency assistance services.

 

Insurance may aid in recovering any expenses that may be incurred if a trip is cancelled or in the event of an accident, sickness or death. Blue Mountain Station Ltd and Blue Mountain Lake Ltd advises using a reputable travel insurance company that covers off road driving and outdoor recreational activities.

 

Blue Mountain Lake Ltd and/or Blue Mountain Station Ltd accepts no responsibility or liability for any failure, on your behalf, to obtain appropriate insurance.

ACCIDENT AND COMPENSATION COMMISSION (ACC)

Should you have an accident resulting in injury whilst in New Zealand, ACC may be able to assist with the cost of treatment and support you require whilst you are here. However, it is important to be aware that you cannot sue for personal injury – ACC replaces that right. Furthermore, ACC only covers treatment and rehabilitation costs whilst in New Zealand; it is not a replacement for travel insurance and does not cover illness, disrupted travel plans or emergency travel for your return journey.

PERSONAL HEALTH AND WELL BEING

  1. i) The New Zealand Government regulations regarding isolation and personal health must be adhered to by all our customers and staff. We cannot admit you onto a horse riding activity if you should be in isolation, please do not put us in that position. We have done all that we can to clean and sanitise equipment utilised on the station.
  2. ii) You agree that: you or any members of your party have not been in contact with anyone who has the Covid 19 virus.

iii) You/ members of your party have no signs of Covid 19 or any other contagious virus

  1. iv) Horse riding can be strenuous by nature; riders should be of reasonable health and fitness and bring all required medication. Blue Mountain Lake Ltd and/or Blue Mountain Station Ltd will require notification of all prior medical conditions, allergies or specific food requirements at the time of booking. Riders need to be aware that we are riding in isolated locations, although we carry a rescue beacon, it can be difficult and timely to access our locations. Riders are expected to manage their own health conditions accordingly, in making the decision to book you are agreeing that you are fit and healthy enough to face the challenges of the horse riding activity you are booking.

UNDERSTANDING THE RISKS


You accept that this activity inherently involves risks and potential hazards. The risks and hazards include, but are not limited to

Falling from the Horse, horse kicking, biting, crushing, knocking you over, trampling, being hit by other riders, riding into obstacles (such as trees, rocks or other riders), being hit by livestock, bitten by working dogs and equipment failure.
You are aware that participating in the horseback adventures offered Blue Mountain Lake Ltd and/or Blue Mountain Station Ltd can be hazardous if they are not conducted with care, control and responsibility.
Acknowledging that these risks, could result in my injury (physical or mental) or even death.

VEHICLES, BOATS AND WATER TOYS

 

All New Zealand Maritime rules must be obeyed while at Blue Mountain Lake.

Blue Mountain Station Ltd or Blue Mountain Lake Ltd cannot be held responsible for any damages that may occur to personal property, boats, boat trailers, vehicles, jet skis or water toys. Only one boat at a time is permitted on the water at any time.

 

All persons using boats, jet skis, water toys or in the water must wear a suitable life jacket. All persons in or on the water must be sober and of sound mind and body at all times. Strict zero tolerance of drugs or alcohol for anyone in or on the water.

 

All children must wear a life vest while in/on the water, on boats, jet skis or water toys.

 

All children must be supervised AT ALL TIMES. All children must be supervised around bodies of water. NO swimming in rivers.

 

Motorbikes, quad bikes or motorised toys are not permitted within the Blue Mountain Lake Boundary. No vehicles of any kind are permitted to drive on the lawn.

 

4x4, MOTORBIKES, QUADBIKES & MOTORISED TOYS

 

Blue Mountain Station Ltd or Blue Mountain Lake Ltd cannot be held responsible for any damages of personal property, vehicles, injuries or loss of life that may occur when driving across the station. All persons driving on the farm must have extensive 4x4 experience, a full driving licence and all vehicles must be suitable for off road driving.

 

The consumption of alcohol or drugs is strictly forbidden. NO alcohol is to be consumed on the farm or while driving on the farm. Guests caught driving while under the influence will be charged for the entire trip duration and be asked to leave the premises.

 

Purchasers, drivers and vehicle owners must be prepared for any vehicle breakdowns or flat tyres before entering the property.

 

Blue Mountain Station Ltd or Blue Mountain Lake Ltd is not required to assist vehicles if they are stuck while crossing the Orari River or anywhere on the station.

 

4x4 vehicles may only be used to access the Basin Hut, The Cook Shop, Blue Mountain Lake, Orari River Track or our privately owned DOC access track. 4x4 are NOT permitted on our marked trails.

 

Motorbikes, quad bikes or motorised toys are not permitted to use our marked trials. Motorbikes and quads are restricted to the Orari River Track.

 

30 km speed limit at all times.

 

Horse riders and walkers have right of way. If you come across horse riders please move well away, STOP and turn off engine until they have passed.

 

 

HORSE RIDERS

 

All persons bringing horses or riding horses on the property accept all liability for their own safety and the safety of their horses.

 

All horse riders must read our ‘Horse Riders Information’ page before arriving. https://bluemountainstation.co.nz/pages/horse-riders

 

All visiting horses must have access to fresh clean water and feed when not being ridden. This is the responsibility of the purchaser, horse rider and horse owner.

 

All horse riders must be completely competent and physically able to ride for many hours.

 

All horses must be fit, safe, sound, in good condition and have excellent health before entering the property. All visiting horses must be well broken in to ride before arriving.

 

Any horses found to be sick, sorry, sore, lame or in poor condition will be turned away. No refunds will be given.

 

All riders must check all the overnight paddocks of any risks before the horses enter. All overnight paddocks and gates must be secured by the purchaser, horse rider and horse owner every time they are used.

 

If you are using your own electric fencing to break up the paddock, it is the purchaser, horse rider and horse owner’s responsibility to secure it safely and remove it before leaving.

 

Horses maybe moved at any time by the station staff if they are in the way or preventing farm work.

 

All overnight paddocks, float parking, around the Basin Hut, Wool Shed or Cook Shop must be cleaned before you leave. A fee will be incurred and charged to the purchaser in paddocks are not cleaned properly.

 

RIDING ABILITIES

Everyone has a different point of view on their riding ability. We will try to explain what we think are the differences. Please be honest to yourself.

Novice: never been on a horse, up to people who can handle a trot or canter

Intermediate: can trot and canter on their own, mount a horse from the ground

Experience: years and years of horse riding experience across various hill country, flat land and terrains.

LUGGAGE LIMITS

Blue Mountain Lake Ltd and/or Blue Mountain Station Ltd applies a strict weight limit of 20kg for luggage. Blue Mountain Lake Ltd and/or Blue Mountain Station Ltd cannot transport over limit baggage cannot be carried. If you have over the limits specified above please contact us prior to your trail commencement. Baggage is at “owner’s risk.”

PACKAGE ITINERARIES

Although Blue Mountain Lake Ltd and/or Blue Mountain Station Ltd has provided an itinerary for the horse riding activities, packages etc these can be subject to alteration without notice and are intended as a guide only. Alterations may come about due to road, trail or weather conditions, strikes, public holidays, local festivals and cultural or other reasons. Due to the nature of the terrain and the remote locations, weather fluctuations can adversely affect road, trail and river conditions that may necessitate alterations to the itinerary with little or no notice. Any additional expenses incurred by the riders are not Blue Mountain Lake Ltd and/or Blue Mountain Station Ltd responsibility. Blue Mountain Lake Ltd and/or Blue Mountain Station Ltd cannot give any guarantee as to the exact arrival and departure times for taxi services and operators utilised by Blue Mountain Lake Ltd and/or Blue Mountain Station Ltd to service the trail ride and Blue Mountain Lake Ltd and/or Blue Mountain Station Ltd will not be

 

 

 

CLEANING FEES

 

All accommodation MUST be left clean and tidy as it was found. Including but not limited to; dishes, towels put in allocated basket, clean floors, bin bags tied and all rubbish inside ready for dumping etc. Anything not left as it was found will incur a cleaning fee.

 

NO shoes to be worn inside of any accommodation.

 

If excessive cleaning beyond our standard practice is needed this will be charged at a minimum of $500 per hour to the purchaser. Extra charges may include charges for loss of revenue to the Blue Mountain Station Ltd or Blue Mountain Lake Ltd by way of property being unavailable to be let whilst awaiting repair and management fee for loss of productivity and project managing (including false fire and smoke alarms).

 

Losing your key and security system shall result in a charge of $50 being added to your account or an account sent to you at a later time.

 

PHOTOGRAPHY AND DRONE FLYING AND PHOTOGRAPHY

 

By completing our booking form and making a booking with us, you/ other members included in your booking form) consent to us taking photos and videos of riders which may be shared on social media by Blue Mountain Lake Ltd and/or Blue Mountain Station Ltd.

In addition, if you wish to share your own photos they too maybe utilised by Blue Mountain Lake Ltd and/or Blue Mountain Station Ltd in their social media

 

Drone flying is strictly prohibited throughout the entire station. At no time may a drone by flown across Blue Mountain Station Land without strict permission.

 

Intrusive filming or photography of others without their consent, especially on private property will be in considered against the Privacy Acts and the Crimes Act. Photographers will be prosecuted.

 

JURISDICATION

The Terms and Conditions included within this document shall be governed by and construed and/or enforced within the laws of New Zealand. You and all members of your booking hereby irrevocably submit to the non-exclusive jurisdiction of the Courts of New Zealand. With respect to any disputes that may arise at any time relating in any way to these terms and Conditions.

CUSTOMER FEEDBACK

Should problems occur during your adventure holiday, then it is in your own best interests to advise your Trail Boss or wrangler immediately, so that steps can be taken to resolve the matter there and then. If you remain dissatisfied, any complaint must be made in writing to us within 30 days of the trail ending.

CATTLE MUSTER TIPS

  • Riding with us is an adventure, experience and you will be involved in the daily work on the trip. No worries, we will show you what to do and will explain to you as much as we can.
  • If you are a rider you will help us in the mornings getting the horses ready. That means leading and keeping them in order when needed.
  • There are plenty of other jobs to do, like helping in the kitchen, doing dishes and cleaning the huts in the morning before we leave.
  • We would like to make clear that you MUST be able to walk downhill. Everything we ride up, we lead the horses down. You must be able to walk downhill, on running shingle and lead your horse at the same time. Good hips, knees and ankles are necessary.

BLUE MOUNTAIN LAKE LODGE

 

By booking, you are accepting the following terms and agree to be legally bound by it. Any persons found breaking these terms and conditions will be immediately required to leave the property and no refund will be given.

 

Important Information

 

All visitors must read and sign a waiver, release form and/or safety induction (dependant on activity) on entry to the station. Terms and Conditions may vary and may be updated at any time up to date of arrival.

 

This area is remote, 30 minutes to Fairlie the closest town. The entire site is designed off-the-grid, with power supplied by a diesel generator. There is WIFI and a landline, there is NO cell phone reception on the station. A Personal Locator Beacon provided by Blue Mountain Lake Ltd will be on site for emergencies. Please be aware of this.

 

River Crossing & Flooding Information - The Lake is accessible by 4x4 ONLY. River crossing experience is needed before booking. By booking you are accepting all responsibility for crossing and admitting competency and ability to safely cross the river unassisted. You are also stating you have a suitable vehicle to cross the river. To get to the lake you must cross the Orari River (a small braided river).

 

In extreme weather events the river can flood. If flooding occurs and the river is uncrossable. Blue Mountain Lake Ltd may offer 2 options.

 

  1. Alternative accommodation to wait until the river recedes (a normal flow usually returns within 24hr post flooding).
  2. Rebooking for another date with 12 months of original booking date.

 

Blue Mountain Station Ltd or Blue Mountain Lake Ltd are not responsible for the weather conditions. All alternate accommodation, rebooking or refunds are at the discretion of Blue Mountain Lake Ltd and Blue Mountain Station’s.

 

All children must be supervised AT ALL TIMES. All children must be supervised around bodies of water. NO swimming in rivers.

 

All accommodation buildings at Blue Mountain Station have guest limits. Extra guests are not permitted at any time unless permitted by Lauren Brown. Accommodation guest restrictions are as follows. Day guests or extra visitors are not permitted at any time. Fines of $500 per person per day will be applied if any extra guests attend.

 

COOKSHOP – 8 People per night per booking

BASIN HUT - 8 People per night per booking

BLUE MOUNTAIN LAKE LODGE - 8 People per night per booking

BLUE MOUNTAIN LAKE LODGE & LAKE HOUSE – 18 people

 

AREA RESTRICTIONS, HUNTING & FISHING

 

Access to any other part of Blue Mountain Station outside of the allocated areas is strictly forbidden. There is a zero tolerance policy on fishing and hunting at Blue Mountain Lake or Blue Mountain Station without permission. No guns, fishing or hunting equipment are permitted on to the property unless permitted by Lauren Brown.
